Contractual terms for purchases through the Sensual Matcha online shop
Between
Dawson, Yolanda & Mochine, Philipp GbR
An der Urania 5
10787 Berlin
Germany
(hereinafter the “Supplier”)
and the customers specified in § 1 (hereinafter the “Customer”).
§ 1 Scope, definitions
(1) The business relationship between the Supplier and the Customer is governed exclusively by these terms and conditions (Allgemeine Geschäftsbedingungen, AGB) in the version valid at the time of the order. Any differing terms of the Customer will not be recognised unless the Supplier expressly agrees to their application.
(2) The Customer is a consumer (Verbraucher) insofar as the purpose of the supplies ordered cannot be attributed predominantly to their trade, business or profession. A trader (Unternehmer) is any natural or legal person or partnership with legal capacity who, when entering into the contract, acts in the exercise of their trade, business or profession.
§ 2 Conclusion of the contract
(1) The products presented in the shop do not constitute a legally binding offer. The Customer may add items to the basket and submit a binding offer to purchase by clicking the “Buy” (“Kaufen”) button. They may change their entries at any time before submitting the order.
(2) The Supplier confirms receipt by email. A contract is concluded only when the Supplier accepts the order by a separate email (order/shipping confirmation).
(3) The contract is concluded exclusively in German.
§ 3 Prices and shipping costs
(1) All prices include statutory VAT.
(2) Shipping costs are shown at checkout and are borne by the Customer.
(3) We offer free shipping only where this is expressly indicated on the product or at checkout.
§ 4 Payment
(1) Payments are made using the methods offered at checkout (e.g. credit card, PayPal, Klarna, Sofortüberweisung).
(2) The invoice amount is due immediately upon conclusion of the contract. If the Customer defaults on payment, the statutory provisions on default apply.
§ 5 Delivery, availability of goods
(1) Delivery is made to the delivery address provided by the Customer; delivery times are communicated on the product page or at checkout.
(2) If the product ordered is permanently unavailable, the Supplier informs the Customer and does not accept the order.
§ 6 Retention of title
The goods delivered remain the property of the Supplier until payment has been made in full.
§ 7 Statutory rights in respect of defects (Gewährleistung)
The statutory rights in respect of defects apply. The limitation period for consumers is two years from delivery.
§ 8 Liability
(1) Claims for damages by the Customer are excluded. This exclusion does not apply to claims arising from loss of life, personal injury or damage to health, claims for damages arising from a breach of essential contractual obligations, or cases of intentional or grossly negligent conduct.
(2) In the event of a breach of essential obligations through slight negligence, compensation is limited to foreseeable damage typical of the contract; this does not apply in the event of loss of life, personal injury or damage to health.
§ 9 Vouchers and promotional codes
Unless otherwise stated, vouchers/discount codes cannot be combined and cannot be redeemed for cash. Promotional codes are valid for a limited period.
§ 10 Right of withdrawal (Widerrufsrecht)
(1) Consumers have the statutory right of withdrawal in accordance with the separate withdrawal instructions (Widerrufsbelehrung).
(2) There is no right of withdrawal for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if the seal has been removed after delivery (e.g. opened Matcha packs).
§ 11 Dispute resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer dispute resolution body (Verbraucherschlichtungsstelle).
§ 12 Final provisions
(1) German law applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction for merchants (Kaufleute)/legal persons under public law is Berlin.
(3) If individual provisions are invalid, the remainder of the contract remains valid.
